PROPER SAUNA, LLC — RENTAL AGREEMENT, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY

READ CAREFULLY. THIS AGREEMENT LIMITS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE.

This Agreement is between Proper Sauna, LLC ("Company") and the person booking ("Renter," "you"). It covers the mobile sauna trailer, wood stove, and all included equipment and accessories (the "Equipment"), and applies to everyone who uses it during your rental ("Guests"). You must be 18 or older, present valid photo ID, and keep a valid credit card on file.

  1. RENTAL AND POSSESSION The rental starts at delivery and setup and ends at scheduled pickup. You are responsible for the Equipment the entire time, including overnight and when unattended. The Equipment stays Company property — you may not move, tow, relocate, sublet, or loan it. Only Company staff reposition the trailer. Late returns or blocked pickup access: [$XX] per hour after a 30-minute grace period.

  2. SITE REQUIREMENTS — YOUR RESPONSIBILITY You are solely responsible for confirming before your rental date that the site is safe, legal, and accessible for a towed trailer: a route at least [10] feet wide with [12] feet overhead clearance, free of branches, wires, gates, and parked vehicles; a firm level load-bearing surface (not mud, sand, soft soil, saturated lawn, or septic field); grade no more than [5] degrees; at least [10] feet of clearance from all structures, fences, decks, vehicles, and dry brush; and no placement under a roof, awning, carport, or tree canopy. You must have the property owner's, landlord's, HOA's, or venue's permission, comply with any applicable local fire codes and restrictions, and disclose all underground utilities, irrigation, and septic components. We are not liable for damage to unmarked underground features, or for ruts, turf damage, or tire tracks from normal delivery.

If our driver judges the site unsafe or inaccessible and no acceptable alternate spot is available, the rental is cancelled on arrival and you forfeit the full rental fee. This applies equally to blocked access, locked gates, or no responsible party present. If you direct us to place the Equipment somewhere we've flagged as marginal, you assume all resulting risk of property and Equipment damage.

  1. WOOD, FIRE, AND STOVE SAFETY These are material terms. Violation is a breach and makes you liable for all resulting damage.

Fuel: burn only dry, seasoned, untreated hardwood sized to fit the firebox without forcing the door. PROHIBITED: any liquid accelerant, gasoline, kerosene, lighter fluid; charcoal or coal; treated, painted, stained, or engineered lumber, plywood, pallets, or particleboard; driftwood; trash, cardboard, plastic, or fabric; green or unseasoned wood; excessive pine or resinous softwood; wax or fire-starter logs. Use only the firewood provided to you by Proper Sauna — do not supply, substitute, or supplement it with your own wood. Use only newspaper, plain kindling, or the starters we provide.

Operation: maintain a hot, clean, dry burn — do not smolder or damper down to make smoke. Do not overfill the firebox. Keep the stove door closed except when loading, and never prop or wedge it open. The ash pan door is the stove's primary air intake — adjust it only as we demonstrate at setup, never remove the ash pan, and never leave it wide open unattended. Do not modify or disable the damper, chimney, spark arrestor, or heat shielding. Water goes only in small ladlefuls onto the heated rocks — never into the firebox or onto the stove body or chimney, and nothing but water and Company-approved oils on the rocks. Keep towels, clothing, bags, and firewood at least [3] feet from the stove and chimney, and never dry anything on or above the stove.

Never leave a lit or smoldering fire unattended. One sober adult 18+ must stay on site and awake whenever there is fire or hot coals. Do not sleep in the sauna while the stove is in use.

Ash: leave it in the stove. You must not remove, shovel, scoop, vacuum, dump, bury, wet, or dispose of ash or coals, and you must not empty the ash pan. All ash and coals remain in the stove for Company removal at pickup. Coals stay dangerously hot for many hours after the fire looks out, which is why disposal is our job and not yours. Stop adding wood at least 2 hours before the end of your rental and let the fire burn down and go out on its own. Never pour water into the firebox or onto the ash to extinguish it.

The fire extinguisher and safety equipment must stay accessible and unobstructed. The stove is an enclosed appliance vented through a chimney with a spark arrestor, so most residential open-burning bans do not apply to it — but you must comply with any local restriction that does cover enclosed wood-burning appliances or air quality. Do not operate in high wind or extreme weather conditions, because of ember and spark risk. During lightning, exit the sauna and move to a permanent structure. If the stove won't draft, you smell smoke in the changing room, or anything looks wrong: stop, evacuate, and call us. In any fire, injury, or emergency, call 911 first, then [PHONE].

  1. HEALTH, SAFETY, AND OCCUPANCY Maximum 8 people inside the sauna at any time. No standing on benches, backrests, the stove guard, tongue, fenders, or roof.

No one under 6 years old may enter or use the sauna under any circumstances. Minors 6 and older may use it only with a parent or legal guardian physically present inside at all times, and only for shortened sessions on the lower bench. Children overheat much faster than adults — exit at the first sign of discomfort. Children may never be left unattended in or near the sauna or trailer. No one under 18 may load the stove or tend the fire. You are responsible for supervising all minors on site.

DO NOT USE THE SAUNA, and do not let a Guest use it, if the person is or may be pregnant, or has any of the following without written physician clearance: heart disease, prior heart attack, arrhythmia, pacemaker, high or low blood pressure, stroke history, clotting or circulatory disorder, diabetes, epilepsy or seizure disorder, respiratory illness, kidney disease, open wounds, heat intolerance or inability to sweat normally, recent surgery, or acute illness or fever. The same applies to anyone on medication affecting blood pressure, heart rate, sweating, or alertness, or taking diuretics, stimulants, sedatives, or anticoagulants.

Do not use the sauna while under the influence of alcohol, cannabis, or any impairing substance — heat plus intoxication sharply raises the risk of unconsciousness, heat stroke, cardiac event, and death. If alcohol is present on site, one designated sober adult must stay responsible for the fire.

Limit sessions to about 15 minutes with cool-down breaks. Hydrate. Exit immediately if you feel dizzy, faint, nauseated, short of breath, confused, or experience chest pain or palpitations. Cool down gradually. The stove, chimney, guard, and rocks cause immediate severe burns — do not touch, and keep children and pets clear. Surfaces and steps get wet and slippery.

Prohibited: smoking, vaping, candles, or open flame other than the stove; glass containers; pets inside the sauna; firearms; sleeping in the sauna; commercial use, resale of sessions, or ticketed events without our written consent; any unlawful activity.

You sign this Agreement both on your own behalf and, to the fullest extent permitted by law, as the authorized representative of every Guest you allow to use the Equipment. You are the responsible party for the entire rental. You agree to: (a) communicate these rules and the safety placard posted in the sauna to every Guest before they use it; (b) refuse use to anyone who is impaired, who falls within the health advisory above, or who will not follow these rules; and (c) supervise use for the whole rental period. You remain fully responsible for the acts and omissions of every Guest, and for any damage, injury, or claim they cause or suffer, whether or not that Guest signed anything. Where a Guest's own claim cannot be waived by your signature, your indemnity obligation in Section 5 applies to that claim.

  1. ASSUMPTION OF RISK AND RELEASE Use of a wood-fired mobile sauna is inherently dangerous and the risks cannot be eliminated. They include severe burns and scalding; fire, smoke inhalation, and carbon monoxide exposure; heat exhaustion, heat stroke, and dehydration; fainting, slips, falls, and head injury; cardiac arrest, stroke, and seizure; shock from rapid cooling; drowning; aggravation of pre-existing conditions; equipment failure; the negligence of other participants; property damage; permanent disability; and DEATH. You knowingly and voluntarily assume all of these risks, known and unknown. You confirm you inspected the Equipment at delivery, received safety instruction, had the chance to ask questions, and accept it in good condition.

To the fullest extent permitted by law, you RELEASE, WAIVE, AND COVENANT NOT TO SUE Proper Sauna, LLC and its owners, members, employees, contractors, agents, and insurers (the "Released Parties") from all claims, demands, losses, damages, and expenses including attorneys' fees arising from the rental, delivery, setup, operation, use, or removal of the Equipment, INCLUDING CLAIMS ARISING FROM THEIR ORDINARY NEGLIGENCE. This does not apply to gross negligence, willful misconduct, or liability that cannot be waived by law. You further agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties against any claim brought by you, your Guests, a property owner, a neighbor, or any third party arising from your rental, your misuse of the Equipment, or your breach of this Agreement. This binds your spouse, heirs, and anyone claiming through you.

We do not insure and are not liable for your or your Guests' personal property. To the fullest extent permitted by law, the Released Parties' total liability for any claim will not exceed the rental fees you actually paid, and they are not liable for indirect, incidental, consequential, or punitive damages. We are not liable for interruptions caused by weather, burn bans, road conditions, equipment malfunction, or anything beyond our reasonable control; our maximum obligation in that case is a prorated refund or reschedule at our discretion.

  1. DAMAGE AND CARD ON FILE CARD ON FILE — WRITTEN AUTHORIZATION By signing below, you give Proper Sauna, LLC written authorization to store the payment card you provided at booking as a card on file with our payment processor, Square, and to charge that card without obtaining a further signature for: rental fees and taxes, late and cleaning fees, consumable replacement, cancellation charges, violation fees, and the cost of repair, replacement, loss, or theft of the Equipment — up to $1,000 per rental for damage-related charges. Amounts above $1,000 remain your obligation and may be pursued separately, including for total loss, theft, or damage from prohibited use.

You confirm that you are the authorized cardholder or have the cardholder's permission, and that the billing information you provided is accurate. Your card is stored and tokenized by Square; Proper Sauna, LLC does not retain your full card number. This authorization remains in effect from booking through 30 days after pickup, and you may revoke it in writing at any time — but revoking it before or during a rental terminates the rental with no refund, and revocation does not release you from amounts already incurred. You agree to keep a valid, chargeable card on file for that period and to notify us if it expires or is replaced.

No separate security deposit is collected; this authorization is your security for the rental. Any assessed charges are billed within 14 business days after pickup and inspection, with an itemized statement and Square receipt sent to the email you provided. You agree not to dispute or charge back amounts properly assessed under this section.

We photograph and document the Equipment's condition at both delivery and pickup; that inspection is the basis for any damage assessment and you may request copies. The Equipment is delivered clean and complete and must come back the same, minus normal wear.

Accessories and consumables are your responsibility — buckets, ladles, thermometers, timers, headrests, bench covers, towels, mats, sauna rocks, stove tools, gloves, fire extinguisher, lighting, speakers, cold plunge, chairs, steps, chocks, locks, and keys. Missing, broken, burned, or stolen items are billed at full replacement cost plus a [$25] restocking fee each.

You are also responsible for damage to wood surfaces, benches, flooring, glass, doors, gaskets, trim, roofing, siding, trailer frame, lights, wiring, tires, and hardware — including burns and scorch marks, gouges, cracks, water damage from misuse, staining from oils or beverages, permanent smoke or cannabis odor, mold from improper closure, adhesive residue, fastener holes, carving, and broken glass.

Flat violation fees, per occurrence, in addition to repair costs:

  • Burning prohibited fuel or using any accelerant: $500

  • Smoking, vaping, or cannabis inside, or odor remediation: $100

  • Exceeding maximum occupancy: $100

  • Moving or towing the Equipment: $100

  • Modifying the stove, damper, chimney, or heat shielding: $100

  • Water or foreign substance in the firebox or on the stove body: $100

  • Discharging the extinguisher outside a genuine emergency, or failing to report an emergency: $100

  • Excessive cleaning, trash, or bodily fluids: $100 and up The $500 fee reflects the elevated fire and total-loss risk that violation creates. All fees are in addition to, not instead of, the actual cost of any resulting repair or replacement.

If the Equipment is stolen or damaged beyond economical repair, you owe full replacement value plus lost rental income during replacement, and must file a police report immediately. If damage takes the Equipment out of service, you owe lost revenue at the standard daily rate per day. You must report any damage, malfunction, injury, or fire-related incident before pickup — failure to report voids any claim that damage was pre-existing. Unpaid amounts accrue interest at [1.5] percent per month or the legal maximum, and you owe our reasonable collection costs and attorneys' fees.

  1. CANCELLATION AND GENERAL TERMS Cancellation more than 48 hours before your rental start time: full refund. Within 48 hours: 50 percent of the rental fee is charged. No-shows and same-day cancellations: no refund. We may cancel or reschedule for severe weather, unsafe roads, burn bans, or equipment issues, in which case you choose a reschedule or full refund. Ordinary rain, cold, and heat are not grounds for a refund.

This Agreement is governed by Georgia law, with exclusive venue in the state or federal courts of Cobb County, Georgia. If any provision is unenforceable it will be narrowed or severed and the rest stays in force; the parties intend the release in Section 5 to be given the broadest effect the law allows. This is the entire agreement and supersedes prior discussions; no oral statement by any Company representative modifies it. Our failure to enforce a term is not a waiver. You may not assign this Agreement. You agree your electronic signature and checkbox acceptance carry the same effect as a handwritten signature, and that we may send notices, invoices, and inspection documentation to the email and phone you provided. Sections 5, 6, and 7 survive the rental period.

  1. ACKNOWLEDGMENT I have read this entire Agreement and understand it. I am signing freely, with no guarantee or inducement made to me. I understand I am giving up substantial legal rights, including the right to sue Proper Sauna, LLC for ordinary negligence. I am at least 18 and legally competent to sign. I sign on my own behalf and as the authorized representative of all Guests I permit to use the Equipment, and I accept full responsibility for them during my rental.

[ ] I am the responsible party for this rental. I will brief every Guest on these rules before they use the sauna, refuse use to anyone impaired or covered by the health advisory, and I accept responsibility for all Guests.
